The 6th Amendment of the United States Constitution guarantees that “In all criminal prosecutions, the accused shall enjoy the right…to have Assistance of Counsel for his defence.” Practically speaking, this means that anybody who is accused of or charged with a criminal offense has a basic right to have a lawyer help defend against those allegations. If you have been accused of a misdemeanor crime, you need a lawyer. If you have been accused of a traffic offense, you need a lawyer. If you have been accused of a high-level felony offense, you REALLY need a lawyer!
If law enforcement wants to question you, first, you need to exercise your 5th Amendment right to say nothing, and then secondly, you need to ASK FOR A LAWYER. You need to say the “magic words,” which are “I want to call a lawyer.”
Some people think, “Only guilty people need lawyers.” This is a myth, and just plain wrong. Even people who thought they have done nothing wrong can find themselves on the wrong side of a criminal prosecution because they cooperated and didn’t realize they could be charged with a crime. You may have heard the quote by President Abraham Lincoln, “Better to remain silent and be thought a fool than to speak out and remove all doubt.” It’s critical recognize that you don’t know everything there is to know about the law.
